These Terms of Service ("Terms") govern your access to and use of the KindaSorta mobile game and related services (the "App"), provided by Nerdysnake Software LLC ("we," "us," or "our"). By downloading, accessing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the App. By using the App, you represent that you meet this requirement and that you have the legal capacity to agree to these Terms.

2. License to use the App

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, solely for your personal, non-commercial entertainment. You may not copy, modify, distribute, sell, lease, reverse-engineer, or attempt to extract the source code of the App, except to the extent such restrictions are prohibited by applicable law.

3. Accounts & Game Center

KindaSorta uses Apple Game Center for sign-in and identity. You are responsible for maintaining the security of your Apple ID and Game Center account and for all activity that occurs under your profile in the App. Your use of Game Center is also subject to Apple's terms and policies.

Scores and rankings are intended to reflect genuine gameplay. We may validate, adjust, remove, or refuse to display any score that we reasonably believe was obtained through cheating, automation, exploitation, or other violations of these Terms, and we may suspend or ban the associated profile. Your display name, score, and rank are visible to other players as part of the leaderboards.

6. Intellectual property

The App, including its game design, software, text, graphics, the alien companion character, audio, and the "KindaSorta" and "Nerdysnake" names and logos, is owned by Nerdysnake Software LLC and protected by intellectual property laws. Except for the limited license granted above, no rights are transferred to you. All rights not expressly granted are reserved.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which explains what limited information we collect and how we handle it. By using the App, you acknowledge the practices described there.

8. Availability & changes

We provide the App on an ongoing basis but may modify, suspend, or discontinue any part of it — including levels, leaderboards, or features — at any time, with or without notice. We are not liable to you for any such modification, suspension, or discontinuation.

9. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms or if we reasonably believe your use poses a risk to the App or other users. You may stop using the App at any time by uninstalling it. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and governing law) will survive.

10. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NERDYSNAKE SOFTWARE LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP. THE APP IS PROVIDED TO YOU FREE OF CHARGE, AND OUR LIABILITY TO YOU IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless Nerdysnake Software LLC and its representatives from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of your misuse of the App or your violation of these Terms or applicable law.

13. Apple App Store terms

These Terms are between you and Nerdysnake Software LLC only, not with Apple. Apple is not responsible for the App or its content. To the extent there is any conflict between these Terms and Apple's App Store Terms of Service (including the Licensed Application End User License Agreement), Apple's terms govern with respect to your use through the App Store. You acknowledge that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you. Apple has no obligation to provide maintenance or support for the App.

14. Governing law

These Terms are governed by the laws of the jurisdiction in which Nerdysnake Software LLC is established, without regard to its conflict-of-laws rules, except where applicable consumer-protection law requires otherwise. Nothing in these Terms limits any mandatory statutory rights you may have as a consumer.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, where appropriate, provide additional notice within the App. Your continued use of the App after an update means you accept the revised Terms.
